What Happened on Loop 375?

At about 6:20 p.m. on Sunday, July 12, 2026, a motorcycle carrying a married couple was traveling westbound on Loop 375 near the Midway exit, close to Yarbrough Drive, in El Paso’s Lower Valley, when a vehicle struck it, according to KVIA and KTSM reports citing the El Paso Police Department (EPPD). Alfredo and Miriam De La Torre were thrown from the motorcycle and died at the scene, police said.

EPPD’s Special Traffic Investigators Unit responded to investigate. The crash closed Loop 375 and its frontage road in the area for nearly 12 hours; westbound lanes reopened around 6:15 a.m. Monday, July 13.

Police said the driver who struck the couple, David McCall, 21, allegedly lost control of his vehicle and left the crash scene on foot. He was later arrested and booked into the El Paso County Detention Facility. According to an EPPD news release cited by KVIA, McCall faces two charges of collision involving death — one for each person killed. What led to the crash, and any findings on fault beyond what police have described, remain part of the ongoing investigation.

Leaving the Scene: What Texas Law Requires

Texas law requires a driver involved in a crash that causes injury or death to stop immediately, render reasonable aid, and provide identifying information, under Section 550.021 of the Texas Transportation Code. When a driver fails to stop after a crash that causes death, the offense can be charged as a felony — consistent with the collision-involving-death charges McCall reportedly faces. A hit-and-run charge addresses the decision to flee; it is separate from any civil claim over what caused the initial collision, which can proceed on its own timeline regardless of how the criminal case resolves.

Who Can Be Affected?

A crash that kills two members of the same family reaches an unusually wide circle of loved ones. People who may have questions about their legal options after a case like this can include:

  • The children, parents, and siblings of Alfredo De La Torre — the family members Texas law recognizes in a wrongful death case
  • The children, parents, and siblings of Miriam De La Torre, who may have a separate wrongful death claim
  • Anyone hurt in a similar crash where the other driver left the scene before police arrived

What Kind of Claim Might Apply?

Attorneys who handle Texas fatal hit-and-run cases generally describe several paths that can apply once the facts are established:

  • A wrongful death claim — under Chapter 71 of the Texas Civil Practice & Remedies Code, the surviving spouse, children, and parents of a person killed by another’s wrongful act can generally seek compensation for their losses, and the estate can bring a survival claim for the deceased’s own damages.
  • The driver’s liability insurance — a claim typically proceeds against the auto liability coverage of the driver found responsible, once that coverage is identified.
  • Uninsured/underinsured motorist (UM/UIM) coverage — drivers who flee the scene often complicate the process of confirming insurance; if coverage turns out to be missing or too low, UM/UIM coverage on the family’s own policy can apply. Texas Insurance Code Chapter 1952 requires insurers to offer this coverage on every Texas auto policy.

A lawyer can obtain the crash report and the outcome of the criminal case as it develops, preserve evidence such as nearby camera video and vehicle data, deal with the insurance companies, and identify every source of compensation that may apply.

Why Acting Quickly Can Matter

Texas law sets deadlines. For most wrongful death and personal-injury cases, the statute of limitations is generally two years, with limited exceptions. Evidence also fades quickly: nearby camera footage is often overwritten in days or weeks, and witness memories fade. A pending criminal case does not resolve a family’s civil claim on its own or guarantee compensation, and it runs on its own schedule. Many families have a lawyer monitoring both tracks on their behalf. The referral and the first consultation are free.
