A 54-year-old San Elizario woman was killed in a head-on crash on Socorro Road in El Paso County early on Sunday, November 1, 2026, and a 61-year-old man was arrested on a charge of intoxication manslaughter and held on a $150,000 bond. Here is what the public record says so far, what that second-degree felony covers, and the parts of Texas law that start operating at the bond hearing rather than at a trial.

What Happened on Socorro Road?

KFOX14 and CBS4 reported on Monday, November 2, 2026 that the El Paso County Sheriff’s Office responded to a head-on crash at about 6:28 a.m. on Sunday, November 1, 2026, in the 11900 block of Socorro Road in San Elizario. According to that account, deputies say a Ford Bronco crossed into oncoming traffic and struck a Chevrolet pickup head-on.

Lydia Burrola, 54, of San Elizario was driving the pickup and was pronounced dead at the scene. Daniel Martinez, 61, was arrested on a charge of intoxication manslaughter and booked into the El Paso County jail on a $150,000 bond. KFOX14 further reported that Mr. Martinez allegedly registered an alcohol concentration of 0.108 after testing, and that he told officers he had had four or five 12-ounce beers at a get-together in Ciudad Juárez before driving home.

KVIA ABC-7 reported the same crash, the same charge and the same $150,000 bond on Sunday, November 1, and reported that the El Paso County Sheriff’s Office had Special Traffic Investigators at the scene and that Socorro Road between Thompson and Socorro was closed as of 7:15 a.m. for an extended period. The KVIA report does not include an alcohol concentration figure, so that number rests on the KFOX14 account alone.

A charge is an accusation rather than a finding. Mr. Martinez is presumed innocent unless and until a court decides otherwise, the facts above come from a preliminary investigation that can change, and nothing on this page assumes what the evidence will show. San Elizario is a city in the Mission Valley in southeastern El Paso County, and Socorro Road is the two-lane farm road that runs along the valley through Socorro and San Elizario.

What the Intoxication Manslaughter Charge Covers

Under Section 49.08 of the Texas Penal Code, a person commits intoxication manslaughter if the person operates a motor vehicle in a public place and is intoxicated and by reason of that intoxication causes the death of another by accident or mistake. Except as provided by Section 49.09, the offense is a felony of the second degree. Under Section 12.33 of the Penal Code, that grade carries imprisonment for not less than two years and not more than 20 years, and a fine of up to $10,000 may be added.

The phrase “by reason of that intoxication causes the death” is doing a great deal of work. It means the State has two separate things to prove rather than one, and a reported number on its own establishes neither of them on these facts.

Why 0.108 and 0.08 Are Two Different Legal Questions

Section 49.01(2) of the Penal Code gives two alternative routes to intoxication. One is not having the normal use of mental or physical faculties by reason of alcohol, a controlled substance, a drug, a dangerous drug, a combination of those, or any other substance. The other is having an alcohol concentration of 0.08 or more. Section 49.01(1) defines alcohol concentration by reference to grams of alcohol per 210 litres of breath, 100 millilitres of blood, or 67 millilitres of urine — so which specimen was taken, and what it was measured against, are part of the question rather than details.

A reported 0.108 sits above the 0.08 line in that second route. What it does not settle is the rest: when the specimen was taken relative to the driving, how it was collected and handled, what the instrument or laboratory record shows, and separately whether intoxication caused the death rather than merely coinciding with it. Experienced DWI and criminal defense attorneys describe the specimen chain, the timing, and the crash reconstruction as the issues that usually decide a Section 49.08 case, which is why the records being generated in the first weeks matter more than the number first reported to the press.

What Texas Law Requires While the Case Is Pending

Most people assume a felony case is decided at a trial. On this charge, several of the consequences are set long before that, by statute.

An ignition interlock on release. Article 17.441 of the Texas Code of Criminal Procedure provides that a magistrate shall require, on release, that a defendant charged with an offense under Section 49.08 have a deep-lung breath analysis device installed on the vehicle the defendant owns or most regularly drives, and not operate any motor vehicle that is not equipped with it. Subsection (b) is the only exit: the magistrate may not require the device if the magistrate finds that to require the device would not be in the best interest of justice. Where it is required, Subsection (c) directs installation at the defendant’s expense before the 30th day after the date of release on bond, and Subsection (d) allows a designated agency to verify and monitor it for a reimbursement fee the magistrate sets at not more than $10 per month.

No deferred adjudication. Article 42A.102(b)(1)(A) provides that a judge may grant deferred adjudication community supervision in other cases, but not where the defendant is charged with an offense under Section 49.08. That removes the outcome many people expect to be available in a first felony case.

A minimum term of confinement even with probation. Article 42A.401(a)(5) provides that a judge granting community supervision to a defendant convicted under Section 49.08 shall require a term of confinement of not less than 120 days as a condition. Article 42A.401(b) adds that if a sentence of confinement is later imposed on revocation, the time served under that condition may not be credited toward it.

Education and licence conditions. Article 42A.403 requires a defendant placed on community supervision for an offense under Sections 49.04 through 49.08 to complete a regulated intoxicated-driving education program before the 181st day after community supervision is granted, subject to the waiver and extension provisions in that article, and Article 42A.407 sets out when a driver licence is suspended and the schedule that applies. Article 42A.257 directs an alcohol or drug evaluation where the judge determines that abuse may have contributed to the offense, and provides that the evaluation may be made after arrest and before conviction if the defendant requests it.

None of that decides any particular case, and a court applies these provisions to the record in front of it. It is the reason a lawyer at the first setting is doing something concrete rather than ceremonial.

Who Can Be Affected

Two households are reached first, and they need different things. The family of the woman who died faces funeral and burial costs, the loss of whatever she earned and of everything she did that nobody was paying for, and the probate steps that have to happen before anyone can act for her estate at all. Texas law also decides which relatives may bring a claim, which is a question families are often surprised to find has a statutory answer.

The person arrested faces a prosecution, a set of release conditions that start running within 30 days, and a separate civil exposure, with the liability insurer on the Bronco making coverage and defense decisions from the first week. In a small Mission Valley community the two families may well know each other, which is one practical reason lawyers tend to handle contact between the parties rather than leaving it to the people involved. Where alcohol was served by a business rather than at a private gathering, Texas has a provider-liability statute; the reported account here describes a private get-together across the border, so whether any commercial provider is involved is not in the public record.

What Kind of Claim or Option Might Apply

On the defense side, a Section 49.08 charge is a second-degree felony with a statutory floor on probation conditions and no deferred-adjudication route, so the work tends to concentrate on the two elements and on the conditions attaching to release. Anyone arrested is entitled to a lawyer, and a defense lawyer can seek the offence report, the specimen and laboratory records, the instrument maintenance records, the Special Traffic Investigators’ reconstruction, and any event data recorder download, and can address the interlock and other bond conditions at the setting where they are decided.

On the family side, Texas keeps two civil claims in separate boxes. Under Chapter 71 of the Civil Practice and Remedies Code, a wrongful death action is for the exclusive benefit of the surviving spouse, children and parents, and Section 71.004 provides that one or more of them may bring it for the benefit of all. Section 71.004(c) adds a date most families never hear about: if none of those individuals has begun the action within three calendar months after the death, the executor or administrator of the estate is directed to bring and prosecute it, unless all of them request that it not be brought. Measured from November 1, 2026, that marker falls around February 1, 2027. Section 71.021 is the separate survival action, which preserves the injured person’s own cause of action in favour of the heirs, legal representatives and estate.

Section 71.006 states that a wrongful death action is not precluded because the death was caused by a felonious act or because a criminal proceeding may be pending, so a family claim does not have to wait for the prosecution to finish. Section 71.009 provides that exemplary as well as actual damages may be recovered where the death is caused by a wilful act or omission or by gross negligence, and Section 71.011 provides that damages recovered are not subject to the debts of the person who died. Insurance usually matters more than any of this in the first month: the liability coverage on the Bronco, and any uninsured or underinsured motorist coverage and personal injury protection the Burrola family carries on its own policies, are separate pots with separate notice requirements. Crime victims’ compensation through the Texas Attorney General’s office is another system with its own forms and filing window. Which of these routes is actually open in one case turns on the policies, the family structure and facts that are not yet public, and a lawyer can read the crash report, the policies and the probate position and explain which ones exist.

Why Acting Quickly Can Matter

The main civil deadline is in Section 16.003(b) of the Civil Practice and Remedies Code: a person must bring suit not later than two years after the day the cause of action accrues in an action for injury resulting in death, and the cause of action accrues on the death of the injured person. Measured from November 1, 2026, that is November 1, 2028. Section 16.001 provides that a limitations period does not include time during which a person entitled to bring the action is under a legal disability, which includes being younger than 18, so a minor child’s position is not the same as an adult’s.

On the criminal side the clock is shorter and it is the magistrate’s, not the court’s. The interlock decision under Article 17.441 is made at release and the installation period runs to the 30th day after it, so the window in which a lawyer can be heard on that condition is measured in days. Evidence runs on its own clock too, and much of it in an intoxication case is perishable or held by someone else: blood specimens and laboratory records, the sheriff’s reconstruction, the event data recorder in each vehicle, phone records, and the two vehicles themselves, which get repaired or scrapped. Preservation letters and records requests sent early are the usual reason the first weeks matter more than the second year. The criminal docket moves on its own schedule, and a family can ask the El Paso County District Attorney’s office about victim notification of settings and hearings in the meantime.
