What Happened on the Southeast Loop 410?
At about 8 p.m. on Saturday, July 4, 2026, San Antonio police were dispatched to a single-vehicle crash in the 9000 block of the Southeast Loop 410 eastbound access road, on the city’s Southeast Side, KSAT 12 reported.
According to an SAPD preliminary report, the driver — a 42-year-old man — was operating the vehicle at a high rate of speed when it veered off the roadway, ejecting his passenger. The passenger, a 43-year-old man, was pronounced dead at the scene by San Antonio Fire Department personnel, FOX San Antonio reported.
Police said the driver showed signs of intoxication and is being treated as the suspect in the case. Neither man’s name had been released as of Sunday morning, and the investigation remains ongoing.
Suspected Intoxication, Speed, and Texas Law
Texas law requires every driver to operate at a speed that is reasonable and prudent under the conditions — not just under the posted limit — under Chapter 545 of the Texas Transportation Code. Separately, when an intoxicated driver causes a death, Texas Penal Code Chapter 49 defines the crime of intoxication manslaughter. Whether any criminal charge is filed here is a decision for investigators and prosecutors, and no charge had been announced as of this writing.
A criminal case and a civil wrongful-death claim are separate tracks: one is brought by the State, the other belongs to the family. Attorneys who handle these cases note that a civil claim does not have to wait for the criminal case to finish, and that the burden of proof in a civil case is different. Police findings that a driver was speeding or showed signs of intoxication are preliminary information — what actually happened is exactly what the ongoing investigation, and any civil case a family pursues, are meant to determine.
Who Can Be Affected?
A death like this reaches an entire family. After a fatal Texas crash involving a suspected intoxicated driver, people who may have legal options can include:
- The spouse, children, and parents of the person who died — even when the person was a passenger in the suspected driver’s own vehicle
- Family members suddenly facing funeral costs, lost income, and the loss of companionship
- Anyone else injured by the same driver in the same crash
Many people do not realize that a passenger’s family can generally pursue a claim against the driver of the very car the passenger was riding in. Attorneys handle that claim primarily through the driver’s auto liability insurance — it is the coverage that exists for exactly this situation.
What Kind of Claim Might Apply?
Attorneys who handle Texas drunk-driving injury and death cases generally describe a few paths that can apply once the facts are established:
- Wrongful death claims — Texas law lets a surviving spouse, children, and parents seek compensation when a death is caused by another’s wrongful act or negligence, under the Texas Wrongful Death Act.
- Survival claims — a separate claim, brought through the person’s estate, for what the person endured before death.
- Dram shop claims — under the Texas Dram Shop Act, a bar or restaurant that served alcohol to an obviously intoxicated person can, in some circumstances, share responsibility. Attorneys describe investigating where a driver was drinking as one of the first steps in these cases.
- Exemplary damages — in cases involving gross negligence, Texas law allows juries to award additional damages beyond compensation, and attorneys note that drunk-driving death cases are among those where courts have permitted them.
A lawyer can obtain the crash report when it is complete, preserve evidence such as receipts and security video from wherever the driver may have been served, deal with the insurance companies, and identify every source of compensation that may apply — so a grieving family does not have to figure it out alone.
Why Acting Quickly Can Matter
Texas law sets deadlines. For most wrongful-death and personal-injury cases, the statute of limitations is generally two years from the date of death or injury, with limited exceptions. Evidence in suspected drunk-driving cases can disappear much faster than that: bar and restaurant video is often overwritten in days or weeks, receipts and witness memories fade, and toxicology results take time to move through the system. Many families choose to talk to a lawyer early for exactly that reason — so the evidence is preserved while it still exists, and so they understand what a case may involve before responding to any insurance offer. The referral and the first consultation are free.
